Gyanesh Kumar is the focus of action from Parties Against the Opposition — this was discussed by various leaders from the opposition during their Meeting of the INDIA bloc. Impeachment was introduced by the Trinamool Congress. Support for Satabdi Roy’s proposal was offered almost immediately following its proposal by several party leaders. The meeting took place under Mallikarjun Kharge’s presidency. The discussion occurred during the Budget Session Meeting held in March 2023.

The opposition’s allegations against the Election Commission (or other Election Officials) centered on many failures to properly administer theirequality at the federal level as well as vote list revisions. This issue has escalated since protest activities have developed across the state of West Bengal recently, including a sit-in at which Mamata Banerjee participated. In support of Satabdi Roy’s proposal, several members of the opposition have committed to pursuing parliamentary action against Gyanesh Kumar relating to his activities as Secretary of the Election Commission of India.

While this was happening, members of the INDIA alliance worked on how they would prepare for Parliament in advance of it opening on March 1. There was a strong desire by all concerned to generate a significant amount of debate around the conflict in West Asia, and Rahul Gandhi attended the meeting to facilitate co-operation and gather broader Commonwealth support.
There were also several reports that showed significant co-operation between the Indian National Congress and Trinamool Congress members. Similarly, several opposition parties discussed taking action against Om Birla, including proposing their own motion of no confidence against him. TMC’s representative stated that the idea of working together was very important to all members. One leader said, “It is about working together”. Therefore, the coordination of the opposition parties became reenergised at this meeting.
Constitution outlines process to remove election chief
Election commissioners’ removal procedures are defined in the Constitution. Article 324 pertains to the Chief Election Commissioner’s office. Removal is treated similarly to the removal of a Supreme Court judge. To remove a commissioner, Parliament must approve this motion through special methods in both Houses. In the Rajya Sabha, at least 50 members must endorse the motion, and in the Lok Sabha, 100 members must endorse the motion before a committee is formed by Parliament to investigate the charges.
The committee then makes findings based on the allegations against the commissioner. Following that, there will be a separate vote in each House, each of which will require a two-thirds majority vote. Finally, the President issues a removal order for the election commissioner, making the process one that requires a broad consensus of both Houses of Parliament. Analysts say the Gyanesh Kumar impeachment debate highlights growing tensions between the opposition and the Election Commission.
