Delhi’s deteriorating air quality created an unexpected discussion in the Supreme Court this week when Chief Justice Surya Kant stated that during his early morning walk, he felt sick. The comment raised concern amongst the many people present in the court that day. Several senior attorneys voiced their anxiety about their own health and indicated that as a result of the poor air quality, older attorneys were suffering more than younger lawyers.
Many of these attorneys asked the Court to look into conducting virtual hearings immediately. The requests made by these attorneys raised fundamental questions regarding the safety of courtroom facilities. The Court is now exploring options for temporary modification and adjustment of procedures based upon these health concerns.
CJI Kant indicated that the Court may need to conduct proceedings remotely within a short period. He stated that he would seek input from members of the Bar Association prior to making any final decisions regarding how to conduct the Court’s business. Looking at the AQI, which continues to surge to the severe range. It became more apparent that a number of attorneys have already begun to limit or restrict the amount of time they spend outside.
Senior lawyers highlight growing health strain
Kapil Sibal shared his worries about the present situation regarding the pollution levels in India, and that older members of the profession inhale toxic air every day. According to him, the air quality index has regularly exceeded 400 for some time now; this indicates that the pollution levels are affecting individuals within the profession and making it difficult for individuals to attend court.
Rakesh Dwivedi made an appeal for universal access to virtual options for all upcoming hearings, as he also experienced significant congestion after going for an early morning walk. Due to this experience, he requested that the bench grant him permission to participate online at the next hearing.
Chief Justice Kant assured the attorneys that he is aware of the negative impact on health and is well-informed. He, too, has encountered such discomfort during his morning walks. In addition, Chief Justice Kant mentioned that he may permit lawyers who are older than 60 years to participate virtually for the next hearing. This concept was favorably received by members of the bar in the courtroom, and the bench will further investigate the option of allowing virtual hearings for members of the bar in the future.

Court examines hybrid limits as pollution intensifies
The Supreme Court of India utilizes both physical attendance and a virtual presence. However, due to the possibility that pollution will influence them to move entirely into a virtual setting, the Chief Justice of India (CJI) stated he will investigate what issues attorneys have and will meet with leaders of Bar Associations on Friday regarding their concerns. That meeting may accelerate the Court’s procedures so that they can establish more safe avenues for conducting hearings.
On Wednesday, Delhi had an AQI value of 335, designated as being “very poor” by officials, who predicted the trend would continue to deteriorate. Pollution has persisted in Delhi for an extended period. Each morning, the capital engine continues to experience significant smoke-related delay. Medical professionals have warned about the increasing number of respiratory ailments that are occurring among all age groups.
The Supreme Court of India also considered appeals involving changes in elections. Many attorneys in that situation requested an electronic option for access to the hearings. Thus, their request made a stronger case for an increase in electronic hearings broadly across many jurisdictions.
The judges will likely implement an interim process based on the results of their evaluation of what is discovered from the survey, in order to ensure a safe environment for attorneys while still assuring that the administration of justice is carried out without interruption.
